These Terms of Service (Terms) govern your use of PlugOut Village, including the mobile application, website, account features, community features and services made available through participating experiences. By creating an account, accessing the service or placing an order or booking, you agree to these Terms and the Privacy Notice.
These Terms are intended to operate under the laws of the Federal Republic of Nigeria. Nothing in them excludes or limits a right, guarantee, refund, remedy or liability that cannot lawfully be excluded, including rights under applicable Nigerian consumer-protection and data-protection law.
1. About PlugOut Village
PlugOut Village is a technology platform operated from Lagos, Nigeria. It brings together participating experiences such as PlugOut Terra, PlugOut Bakery, PlugOut Express, HideOut Lagos, HitLab Studio, RedZone and PlugOut Connect.
Some goods and services are supplied by independent participating businesses or organisers. The applicable business is responsible for the description, quality, safety, availability, preparation, fulfilment and lawful delivery of its goods or services. PlugOut Village provides the platform, payment and support tools described in the relevant flow and will assist with issues that are within our control.
2. Eligibility and accounts
- Provide accurate, current information and keep it updated.
- Keep your password, device and session credentials confidential. You are responsible for activity carried out through your account unless you promptly report unauthorised use.
- Use the service only if you can lawfully enter into these Terms. If you are under the age or legal capacity at which consent is required, use the service only with parent or legal-guardian involvement as required by Nigerian law.
- Do not create accounts to impersonate another person, evade a suspension, abuse promotions or interfere with another person’s rights.
3. Experiences, listings and availability
Menus, products, prices, opening hours, spaces, programmes, events, ticket limits and other details may change. A listing is not a guarantee that an item or space will remain available. The information shown at checkout or booking is the information that applies to that transaction, subject to correction of obvious errors and applicable law.
Experience-specific rules, minimum spends, age requirements, dress codes, cancellation terms and event conditions may apply. They will be shown where available and form part of your agreement for that booking or purchase.
4. Orders and bookings
When you submit an order, reservation, ticket request or other booking, you are making a request. The request is accepted only when the app or participating experience confirms it. We may reject or cancel a request where an item is unavailable, a price or catalogue error occurred, payment is not authorised, information is incomplete, or cancellation is needed for safety, fraud prevention or legal compliance.
For food orders, the server-side catalogue and price are authoritative. Displayed cart totals may be estimates until the order is accepted. You must provide accurate contact, pickup, delivery and guest information and promptly report an incorrect, missing, unsafe or delayed order.
5. Prices, payment and refunds
- Prices and charges are shown in Nigerian naira unless another currency is expressly displayed. Taxes, delivery charges, service charges, minimum spends or other mandatory charges will be shown where applicable.
- Payments may be processed by an authorised provider such as Paystack or Stripe. We do not receive or store your full card number, PIN or payment password.
- A payment redirect, authorisation or pending status is not by itself confirmation that an order or booking has been accepted. The status shown by the Village and the payment provider may need to be reconciled.
- Refunds, reversals and cancellations are handled according to the applicable transaction terms, provider rules and Nigerian law. Where a payment dispute or failed electronic payment is involved, contact us promptly and also use the payment provider or bank dispute channel where appropriate.
6. Cancellations and consumer rights
Cancellation windows and refund rules may differ by experience, product, event and booking. They will not be used to take away mandatory rights under the Federal Competition and Consumer Protection Act, 2018, applicable consumer regulations, payment rules or any other law. If a service is not supplied as agreed, is materially defective, or a payment is taken without the corresponding service, contact hello@plugoutvillage.com with the order or booking reference so we can investigate and pursue the appropriate remedy.
Nothing in these Terms prevents you from reporting a complaint to a competent Nigerian regulator or seeking a remedy available in court.
7. Community content and conduct
You retain ownership of content you create, but you give PlugOut Village a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, moderate, display and distribute that content only as needed to operate, secure and promote the service. This licence ends when the content is deleted, except for copies retained for legal, safety, backup or dispute purposes.
You must not post or upload content that is unlawful, deceptive, defamatory, discriminatory, threatening, sexually exploitative, infringing, unsafe, invasive of privacy or designed to facilitate fraud. Do not upload malware, scrape the service, harvest data, manipulate reviews, bypass access controls or interfere with payments, pricing, availability, moderation or another person’s account.
We may remove, restrict or preserve content, suspend features or refer conduct to authorities where reasonably necessary to protect users, businesses, the service or the law. We do not promise to review every item before it appears.
8. Intellectual property
PlugOut Village and its licensors own the app, website, branding, software, design, text and other materials supplied by us. We grant you a limited, revocable, non-exclusive, non-transferable licence to use them for personal, lawful use of the service. You may not copy, reverse engineer, resell, frame, modify or commercially exploit them except with written permission or where law permits.
Business names, logos, photographs, menus and other materials supplied by participating experiences belong to their respective owners. If you believe content infringes your rights, contact us with enough information to investigate.
9. Privacy and communications
Our Privacy Notice explains how we process personal data under Nigerian data-protection law. We may send essential service, security, booking, order and account communications. Promotional notifications are controlled by your settings where available, and you may opt out of marketing communications without disabling essential service messages.
10. Third-party services
The app may link to or depend on payment, authentication, hosting, delivery, mapping, media, notification or other third-party services. Those providers may impose their own terms and privacy notices. We are not responsible for a third party’s independent systems, content, delay, outage or processing, although we will take reasonable steps to support a transaction that runs through the Village.
11. Availability and disclaimers
We work to keep PlugOut Village useful and secure, but the service may be unavailable, delayed or changed for maintenance, connectivity, provider failure, events outside our control or other operational reasons. To the extent permitted by law, the service is provided on an “as available” basis and we do not guarantee uninterrupted access, error-free operation, continued availability of a listing or that every experience will meet your expectations.
We do not provide medical, financial, legal or safety advice through the service. Check the participating business’s information and use your own judgment, especially regarding allergens, dietary requirements, alcohol, age restrictions, physical activities and event safety.
12. Responsibility and liability
To the extent permitted by Nigerian law, we are responsible for losses directly caused by our breach of these Terms, negligence or unlawful conduct. We are not responsible for indirect or consequential loss, loss of opportunity, or the independent acts or omissions of a participating business or third-party provider, except where the law requires otherwise.
Nothing in these Terms limits liability for fraud, death or personal injury caused by negligence, wilful misconduct, infringement of non-excludable rights, or any other liability that cannot legally be limited. You remain responsible for losses caused by your misuse of the service, fraud, unlawful conduct or breach of these Terms.
13. Suspension and termination
You may stop using the service and delete your account at any time. We may suspend or terminate access where reasonably necessary for security, fraud prevention, non-payment, serious or repeated breach, legal compliance or protection of users and businesses. We will provide notice where practical and lawful. Clauses concerning payments, content, intellectual property, liability, disputes and retained records continue to the extent necessary after termination.
14. Changes to these Terms
We may update these Terms when the service or law changes. We will publish the updated version and effective date here. If a change materially affects your rights or an existing paid transaction, we will provide additional notice where required. Continued use after the effective date means you accept the updated Terms for future use.
15. Nigerian law and complaints
These Terms are governed by the laws of the Federal Republic of Nigeria. Please contact us first at hello@plugoutvillage.com so we can try to resolve a complaint quickly. Subject to mandatory consumer protections and any jurisdiction that cannot lawfully be excluded, the courts of Lagos State or the appropriate Federal court in Nigeria may hear disputes arising from these Terms.
